[00:01:31] It did. Well, our kids go into kindergarten soon, so we got a budget for school.

[00:05:47] On that basis, let's get into our first topic for today.
[00:06:01] So Dwight, now that we know all of that about us, now we have to do a little bit of a review
[00:06:06] of season eight.
[00:06:07] It was a phenomenal season.
[00:06:09] Mm-hmm.
[00:06:10] Yeah.
[00:06:11] We covered a lot of ground.
[00:06:12] We really did.
[00:06:14] And Dwight and I were talking about some of the episodes and we were like, wow, that was
[00:06:18] season eight.
[00:06:19] I can't believe it.
[00:06:19] It happened so long ago.
[00:06:20] It feels like forever.
[00:06:22] No, it just happened not too long ago.
[00:06:25] Yeah.
[00:06:26] And yeah, I mean, some of the ones we had, like I talked to Jason Albert, who is the global
[00:06:31] chief privacy officer at ADP.
[00:06:33] That was actually one of the most downloaded episodes.
[00:06:35] It was on the EU AI Act, which really kind of set the tone for most of the year was about
[00:06:44] AI.
[00:06:44] AI.
[00:06:45] Right.
[00:06:47] And we'll continue to be about AI.
[00:06:49] Oh my gosh.
[00:06:50] Yeah.
[00:06:50] I mean, everything AI has been influencing a lot of HR.
[00:06:55] And so we've had lots of discussions, whether it was before HR tech or all the HR tech episodes
[00:07:01] really had something to do with AI.
[00:07:04] There are 14 HR tech episodes.
[00:07:06] Each one of them had something to do with AI.
[00:07:09] It's crazy.
[00:07:11] I mean, it's just top of mind and, and kind of the, you know, kind of the, what's, how
[00:07:21] do I want to describe it?
[00:07:22] The end thing to do our product as AI, you know, and trendy, go buy a candy bar at the convenience
[00:07:30] store and it's an AI generated candy bar.
[00:07:33] You know, that kind of crap that you see.
[00:07:35] I hear they have less calories.
[00:07:37] Yeah.
[00:07:38] Well, you know, it's all like a hologram, you know, you don't get to taste it.
[00:07:44] It's just, you know.
[00:07:45] Well, you get the guilt from eating it, but then at the end you're like, still makes you,
[00:07:50] still makes you obese, but you know, you don't get the flavor that goes with it.
[00:07:56] Yeah.
[00:07:56] It's Chet GBT flavored.
[00:07:59] Right.
[00:08:00] Exactly.
[00:08:02] Although you could get a Google one that would be Gemini flavored.
[00:08:05] True.
[00:08:06] Yeah.
[00:08:07] So there are lots of other, lots of other varieties now.
[00:08:09] Yeah.
[00:08:10] But then there were some other really cool conversations we got into, you know, we still
[00:08:14] had conversations about inclusive leadership and inclusive language.
[00:08:18] We had a really emotional couple of episodes where we talked to Dr. Mark Scherer as well
[00:08:24] as Brandy Muse and the Mark Scherer episode was really about learning about our emotional
[00:08:31] intelligence and what drives it.
[00:08:34] Right.
[00:08:35] And the Brandy Muse episode was about mental health and very powerful, very emotional.
[00:08:42] You know, it's interesting because Mark's episode, I kind of went into it like, okay, is this
[00:08:50] going to be a lot of psychological mumbo jumbo?
[00:08:53] Yeah.
[00:08:54] I went into it a little bit skeptical.
[00:08:56] Oh yeah.
[00:08:56] To be perfectly honest.
[00:08:58] But man, it didn't take long for me to realize it was something totally different.
[00:09:04] He's a brilliant person and really kind of, you know, whether he played a Jedi mind trick
[00:09:10] on us or not, I don't think so.
[00:09:12] He's just brilliant.
[00:09:13] He's brilliant.
[00:09:14] And his advice was very sage.
[00:09:17] Very sage.
[00:09:18] Exactly.
[00:09:19] He has, he has definitely dialed it in with that.
[00:09:23] Yeah.
[00:09:24] Yeah.
[00:09:24] So that made that episode a lot of fun.
[00:09:27] Yep.
[00:09:27] Yeah.
[00:09:28] And Brandy Muse, that was, that was definitely an emotional episode and.
[00:09:35] It was hard.
[00:09:36] Yeah.
[00:09:36] It really was.
[00:09:38] It really was.
[00:09:39] I mean, I, I'm sure there's not a listener out there that was not personally impacted by
[00:09:44] listening to both Mark and Brandy's episode.
[00:09:48] There's no way you couldn't be because we're all impacted by mental health and in one way
[00:09:53] or another, whether it's our family, whether it's us, whether it's our friends.
[00:09:58] Oh my gosh.
[00:09:58] Yeah.
[00:09:59] Yeah.
[00:10:00] And, and the, the Brandy episode really focused on mental health and suicide as well.
[00:10:05] And I think it was actually part of, if I'm not mistaken, suicide prevention month.
[00:10:10] Correct.
[00:10:10] Yeah.
[00:10:11] September.
[00:10:12] And it was, it was just hard.
[00:10:14] I mean, that episode should have been sponsored by Kleenex.
[00:10:18] Right.
[00:10:18] Exactly.
[00:10:20] Or Scott tissue.
[00:10:21] Not to, not to pick a brand.
[00:10:23] But it needed, it was the conversation that needed to be had.
[00:10:25] Oh, absolutely.
[00:10:26] You know, the, one of the things when I was, when I was posting the episodes on, on LinkedIn,
[00:10:33] um, I made the statement and I still stand by this, that we have got to start talking
[00:10:40] about this because it's around us every day.
[00:10:44] And it's a shame that we're in 2024 and it's still such a taboo subject.
[00:10:53] And, but we're all impacted by it.
[00:10:56] So there's, you know, defies logic.
[00:10:58] But, well, I think it comes from the fact that death is such a hard subject to talk about.
[00:11:04] Yeah.
[00:11:04] Just flat out.
[00:11:05] It's just hard.
[00:11:05] Whether, whether you are feeling down or depressed or whether you have someone who you know who is,
[00:11:13] who may have actually thought about suicide.
[00:11:16] It's something that deeply, deeply upsets us and we try and shut it off.
[00:11:23] And that's why we use humor.
[00:11:24] We use laughter.
[00:11:26] We use all different types of mechanisms to kind of shield ourself from it.
[00:11:30] Right.
[00:11:31] When your point, and it's a really good point, we've got to be human about it.
[00:11:36] We've got to be honest about it and we got to face it.
[00:11:39] It's hard.
[00:11:40] Right.
[00:11:41] It really is.
[00:11:42] Sometimes I wonder if it's the actual repercussions or the fear of repercussions that come from talking
[00:11:49] about it.
[00:11:50] And I'm not, I'm not sure there's an answer to that actually, but.
[00:11:54] I don't think there is.
[00:11:55] But I am glad that, that through this podcast, we were able to get it out there and at least
[00:12:03] be able to start the conversation here.
[00:12:06] Yeah.
[00:12:07] Well, we're, we don't shy away from difficult topics.
[00:12:11] That was a difficult topic on lots of levels from an emotional perspective.
[00:12:15] Right.
[00:12:16] But, um, as again, to your point, I don't think any of us have ever, I don't think any of us
[00:12:24] have been isolated from someone or something that is either threatened suicide or has talked
[00:12:33] about it or has thought about it.
[00:12:35] Everybody, you know, gets affected by that.
[00:12:38] Right.
[00:12:39] Yeah, you're right.
[00:12:40] It's important.
[00:12:41] It was an important episode.
[00:12:43] Definitely.
[00:12:44] And then we had some that weren't quite as emotional as that.
[00:12:48] No, no.
[00:12:49] We had some more lighted, lighthearted ones, but you know, the one that there was actually
[00:12:54] quite factual, very, very intelligent Chris Fusco, um, from salary.com who talked to us
[00:13:01] about, um, job satisfaction and how to measure it.
[00:13:05] That was, that was an interesting conversation.
[00:13:07] I didn't know that where that was going to go either, but that was, that was fascinating.
[00:13:11] Yeah.
[00:13:12] Yeah.
[00:13:13] Chris is, Chris has got such an interesting way of looking at things and, and it really
[00:13:18] is genius in so many ways.
[00:13:20] Oh yeah.
[00:13:21] As, as, because I think, I think organizations have been trying to measure satisfaction for
[00:13:29] ages and they've just never found the secret sauce.
[00:13:32] And granted we didn't, it's not like we came up with the whiz bang secret sauce from our
[00:13:38] discussion with, with Chris, but, but he looks at it in a little bit different way.
[00:13:45] And, uh, you know, hearing him, hearing his thoughts on it and, uh, you know, how you go
[00:13:52] about it and how you look at it.
[00:13:54] Um, just gave interesting context to the entire conversation.
[00:13:59] Absolutely.
[00:14:00] And then the other conversation that I thought was quite fascinating was Kevin Yates with the
[00:14:05] L and D's impact to the business.
[00:14:07] Again, we, we had been kind of trying to get more learning and development experts on the
[00:14:14] program.
[00:14:15] And I think we had hit a home run with that one.
[00:14:17] Kevin was phenomenal and a really good, a great way of thinking about the investments
[00:14:22] we're making in L and D.
[00:14:23] And then to kind of piggyback on that, we had a good conversation or great conversation
[00:14:28] with Stacey Krivins, um, about upskilling and reskilling employees.
[00:14:32] And, uh, those, those two episodes kind of went hand in hand and they were like right next
[00:14:37] to each other.
[00:14:38] Yeah.
[00:14:38] Stephanie Krivins.
[00:14:40] What did I say?
[00:14:41] Stacey.
[00:14:42] Oh my goodness.
[00:14:43] I know who you're talking about.
[00:14:44] I'm sorry, Stephanie.

[00:14:56] The reskilling and upskilling that conversation is hitting a lot.
[00:15:00] And I'm actually going to talk about that at the end a little bit.

[00:15:10] I don't want to miss Wendy Sellers and Alyssa DeVere.
[00:15:14] We had really great conversations with them about a couple of really interesting things.
[00:15:20] One of the things you highlighted last year was, or one of the last seasons was, um, ERGs
[00:15:25] and the benefit that employers get from that.
[00:15:28] Right.
[00:15:28] And, um, Wendy talked about the good old topic of attraction and retention of employees and how that has changed over time.
[00:15:38] And that was fascinating.
[00:15:39] And then the entire HR tech series, which again, 14 episodes that I recorded out at, uh, Mandela Bay in Vegas.
[00:15:50] Oh my gosh, Dwight.
[00:15:51] It was busy.
[00:15:52] I, yeah.
[00:15:54] I mean, I'm looking at them on my screen right now and it's just like, see it scrolling and scrolling.
[00:16:01] Yeah.
[00:16:02] What was fascinating is every discussion, again, every discussion pretty much focused on AI and its impact to HR.
[00:16:08] But every, every conversation was just kind of came from a different perspective and just brilliant.
[00:16:14] Like I can't even mention one of the people because that would be kind of unfair to the rest because they were all phenomenal episodes.
[00:16:22] And I learned a lot from them and I enjoyed every one of them because every single person that we interviewed was a friend.
[00:16:29] And, and if they weren't a friend at the beginning, they were definitely a friend at the end.
[00:16:32] So it was just, it was just wonderful.
[00:16:35] Just a great set of conversations.
[00:16:37] Yeah.
[00:16:37] And a lot of context for a lot of different topics and the context of how they all weave together.
[00:16:44] They're not all independent from each other.
[00:16:47] Although I do have a, I do have a question for you.
[00:16:50] The, you know, um, looking at the fact that you and Adriana DiNeno recorded at HR tech, the, all right.
[00:17:00] So listeners for, for those of you who don't know David and Adriana, every time we record, I swear their brother and sister.
[00:17:09] Cause they're just at each other.
[00:17:11] Uh, we had a little bit of that.
[00:17:13] I wondered what it was.
[00:17:14] I mean, you guys didn't, you guys didn't drop the gloves and.
[00:17:18] Oh, no, no, no.
[00:17:19] We had a fun time.
[00:17:20] No, there was no, there's no fisticuffs, no, uh, rough housing.
[00:17:24] It was, it was just a lot of fun.

[00:17:41] No, but every one of these conversations had a different spin on how artificial intelligence was really affecting the world of HR.
[00:17:49] And it was just a great set of conversations.
[00:17:51] I was very excited about every single one of them.
[00:17:53] Yeah.
[00:17:54] And coming from a genius crowd, you know?
[00:17:56] Oh yeah.
[00:18:09] So that's the look back.
[00:18:10] I think the look ahead is pretty fascinating because we have a lot of really cool episodes that we've already done.
[00:18:19] And some that, that we're going to be doing, I actually think we've recorded fully a half of next season already.
[00:18:27] Mm-hmm.
[00:18:28] And if we haven't recorded them, we're, we're about, we're going to probably record a lot in the new year.
[00:18:34] And the reason is because obviously we had just gone through a presidential election, which everybody knows about by now.
[00:18:42] And there'll be a lot of repercussions from that.
[00:18:44] And some of which we may talk about in the predictions, but that we actually held off on a lot of the recording until after the election, because so much will change based on the new administration and how things might work.

[00:19:03] There are a lot of predictions on how it won't work, but.

[00:20:03] Well, I have seen different news articles that there's a backlash of, you know, people really getting the survey fatigue.
[00:20:16] Now, can I say that it was significant the way that I predicted it?
[00:20:21] Probably not.
[00:20:22] But then again, that was six months ago.
[00:20:25] Oh, my God.
[00:20:26] That's a rant that I have.
[00:20:28] Don't get me started.
[00:20:30] Every little.
[00:20:31] All right.
[00:20:32] Anyway, I'll stop.
[00:20:34] Don't get me started.
[00:20:37] Poor Dwight.
[00:20:38] He must have just gotten off of one of those survey calls and was like, oh, yeah.
[00:20:45] Running into the Hulk.
[00:20:46] Every time you go buy something at the store, survey pops up somewhere or somehow.
[00:20:52] Yeah.
[00:20:53] Well, you could just not go to the store.
[00:20:58] Actually, that wouldn't help because you get stuff from Amazon or Uber Eats or wherever.
[00:21:04] Yeah.
[00:21:05] The AI-based surveys would find me somewhere or another.
[00:21:08] Yeah.
[00:21:09] Well, you have to serve the AI overlord.
[00:21:11] Yeah, exactly.
[00:21:13] So how do you think you did on that prediction?
[00:21:15] Oh, God.
[00:21:17] I'll give myself a, let's say, a B minus.

[00:21:21] You know, I think the six-month time frame is a little too short to really see more significant
[00:21:29] backlash.
[00:21:30] I think we have to take into consideration for this set of predictions that we do.

[00:21:45] Mine was that more companies would start taking pay transparency as de facto, no matter where
[00:21:53] they operated from, and actually start posting ranges.

[00:21:59] Not sure that really came through 100%.
[00:22:03] I think that many did, but not from a miserable perspective.
[00:22:08] So I'm going to give myself definitely a C on that one.
[00:22:13] See, I'm, I'm going to disagree with you.
[00:22:17] I think that you deserve a higher grade and here's why.
[00:22:20] But you always think I deserve a higher grade.

[00:22:50] So I think we have to give some context about that though, because, you know, you have to
[00:22:55] tell some people who don't know what we're talking about, because I think you're right.
[00:22:59] Yeah.
[00:23:00] I mean, the new, the new FLSA rules were proposed and put into effect starting with one tier in
[00:23:08] July one and the second tier at January one.
[00:23:13] And so companies were having to scramble to determine whether or not their employees should
[00:23:20] be exempt or non-exempt, what the threshold should be.
[00:23:23] Should they have to pay them more?
[00:23:25] So they were busy turning through that.
[00:23:28] The legislators were busy worrying about that.
[00:23:32] So there, there probably wasn't as much pay transparency enacted legislatively.
[00:23:38] Yeah.
[00:23:39] So that's, that's, that's where I say, I, I think that kind of overshadows things.
[00:23:45] So that's possible.
[00:23:47] And, and, and just so we're, we're clear that this, there was a ruling just recently from
[00:23:53] the Eastern district of Texas, which basically said that FLSA rules should not be on a salary
[00:24:00] basis.
[00:24:01] There should be on the duties tests where if someone passes a duty test and they are exempt
[00:24:09] from getting paid overtime.
[00:24:10] And that was the, that was their ruling that whether it was the 2016 legislation, the 2019
[00:24:19] or the 2024, uh, not legislation, the rule setting, the 2016, 2019 or 2024, that they should
[00:24:27] not be based on salary.
[00:24:29] They should be based on the duties tests and thus overturn both the July and January increases
[00:24:36] to the federal minimum for exempt status.
[00:24:40] And yeah, many companies were really worried about that as, uh, as Dwight said, and they
[00:24:48] basically now need to rethink everything.
[00:24:51] So I, I not only agree with you that that may have prevented them from worrying about
[00:24:56] transparency to their detriment, but also now they're going to have to start thinking
[00:25:00] about what we do.
[00:25:01] What do we do now?
[00:25:02] Given the fact that that exemption change is now off the books, what do I do?
[00:25:07] Right.
[00:25:09] Yep.
[00:25:10] So it pushes companies are really going to wrestle with that big time.
[00:25:13] Yeah.
[00:25:14] Yeah.
[00:25:14] I don't think they're going to wrestle with it over Thanksgiving and definitely not over
[00:25:18] Christmas, but, um.
[00:25:20] Yeah.
[00:25:20] Maybe around the Thanksgiving table with plenty of wine flowing.
[00:25:23] Yeah.
[00:25:24] And the ultra fast as they sleep, they're going to have nightmares about the FLSA status.

[00:26:07] So let's make it a six month prediction.
[00:26:11] Dwight, what's your prediction?
[00:26:13] You always go first.
[00:26:14] I'm having trouble with this one being a six month prediction, but actually with the pace
[00:26:19] of change, it's possible.
[00:26:22] So here's where I'm going to go with this.
[00:26:25] I'm going to talk about AI.
[00:26:27] I know that it feels like a dead horse that we beat over and over again, but it's not going
[00:26:35] away.
[00:26:35] So here's my take on this.
[00:26:38] Okay.
[00:26:38] Um, I just did a piece on AI and the impact of customer service personnel.
[00:26:45] And I think that number one, there are some pretty solid stats on what's happening with
[00:26:53] customer service positions.
[00:26:55] It's been, it's actually been a downhill slope for at least the last 10 years.
[00:27:00] When you look at the Ls statistics, the total numbers were going, going up, but the growth
[00:27:06] rate was actually going down.
[00:27:07] Wow.
[00:27:08] So now we've reached this peak.
[00:27:11] So we've got this data that tells us that, and we have a lot of data that indicates that
[00:27:18] AI is becoming much more entrenched than customer service.
[00:27:23] We all feel it.
[00:27:24] Every time we call for customer support, we're probably, uh, talking with an AI agent, or if
[00:27:31] we're interacting via text at a chat bot.
[00:27:33] And so customer service is really being hit with this.
[00:27:37] And, and one of the, so my prediction is the downstream impact of this is that HR is going
[00:27:47] to have more of their work cut out for them in terms of, um, hoping strategize on reductions
[00:27:56] in force, which actually, I don't think we're going to see mass reductions in force.
[00:28:01] Um, I think we're going to see a shift and I'll talk about that in a second.
[00:28:05] The, um, the other area where they're really going to be challenged is the evaluation of
[00:28:13] reskilling and upskilling positions.
[00:28:15] And that's where, that's where I say, I don't think that we're going to see massive reductions
[00:28:20] in force because with the implementation of AI, what people don't realize is you need
[00:28:26] significant resources for the care and feeding of that AI.
[00:28:30] So you're going to see a shift in the kinds of positions, but that's really going to up
[00:28:35] the pressure on HR for implementing good reskilling and upskilling initiatives.
[00:28:42] And I think with the pace of change of AI, I do think we're going to see, we're going
[00:28:48] to see pretty immediate results with that.
[00:28:51] And when I say immediate, I mean that six month time frame.
[00:28:55] Okay.
[00:28:55] So that's my long winded prediction.
[00:28:58] I like it.
[00:29:00] And hopefully in six months, we'll, we'll see some movement on that.
[00:29:06] Yeah, definitely.
[00:29:07] And how about you, sir?
[00:29:10] I'm going to go to the economic slash political world.
[00:29:14] And I'm going to say that the, um, the new incoming Congress, um, the Senate and the house
[00:29:22] and the new executive branch are going to make sweeping changes to a lot of the things,
[00:29:28] a lot of the HR facing regulations that had changed in the last four years and, uh, overturned
[00:29:37] that's not rocket science.
[00:29:39] We all knew that was going to happen, but I think one of the areas that it's specifically
[00:29:43] going to hit is, um, DE&I.
[00:29:47] And I think we're going to see some significant movement in that.
[00:29:52] And, um, I take it from the perspective.
[00:29:55] I don't think that's a good thing.
[00:29:57] Now we've talked a lot about DE&I and some of the repercussions from the Supreme Court's
[00:30:04] rulings recently over the last, actually the last four or five months.
[00:30:08] Mm-hmm.
[00:30:09] And, um, one of the sage people that I get to work with every day, Lena Turner and I had
[00:30:14] a conversation about this and there's an upcoming episode on it, um, in season nine and not to
[00:30:21] steal that thunder.
[00:30:22] But I think one of the things that we're going to start seeing is companies are not going
[00:30:26] to be talking about the DE&I, but it's already built into their DNA and having a fair,
[00:30:33] equitable, inclusive workforce is going to be just part of what they do.
[00:30:39] So my prediction is that a lot of regulations, a lot of rules, a lot of norms that we had
[00:30:46] taken for granted over the last at least four years around DE&I are going to start going away,
[00:30:51] but they're going to be replaced by the way normal operations already are happening,
[00:30:57] which is with the spirit of DE&I.
[00:31:00] Okay.
[00:31:00] So it's my hope at least that at least the spirit will still be there.
[00:31:05] It'll be challenged.
[00:31:07] Um, you know, oh yeah.
[00:31:10] Very hard challenges with it, but yeah, I'm hoping you're, I'm hoping you're correct with
[00:31:16] it.
[00:31:17] Let's pray.
[00:31:17] Yeah.
[00:31:18] Yeah.
[00:31:19] So that's our predictions.
[00:31:21] Um, one on AI in the world of, uh, business and how business gets done and how people get
[00:31:29] retrained and whether DE&I becomes part of the soul of how companies operate despite changes
[00:31:37] in legislation and, and, uh, rulemaking.
[00:31:41] Wow.
[00:31:42] Doing the right thing for the right reason.
[00:31:43] Yeah.
[00:31:44] Wait a minute.
[00:31:45] Wow.
[00:31:46] I took a turn on this podcast episode, didn't I?
[00:31:48] Yeah.
[00:31:51] No, but it's, I mean, it's good.
[00:31:53] We've got to talk about it.
[00:31:55] Yeah.
[00:31:56] Um, I think a lot of, I think a lot of people are, are trying to figure out what that's going
[00:32:01] to look like in the future.
[00:32:03] Let's say this, that the world of work has been evolving for decades.
[00:32:09] It's not a new thing, whether it's PCs on desks in the nineties, whether it's the internet
[00:32:15] in the late nineties, early two thousands, whether it's chat GPT in 2022, 2023.
[00:32:23] Yeah.
[00:32:23] All those things have led to an evolution of how work gets done.
[00:32:28] So, right.
[00:32:29] You know, these are somewhat baby steps.
[00:32:32] And as we said, six months is tough to see lots of change.
[00:32:35] Although the pace of change is happening really fast as you've done before.
[00:32:39] Yeah.
[00:32:39] Um, and we've been so, we've been living in it.
[00:32:43] We've been swimming in it for so long that we're kind of numb to a lot of the change that
[00:32:46] we've seen.
[00:32:48] Right.
[00:32:48] Exactly.
[00:32:49] We don't even realize it's happening.
[00:32:51] It just.
[00:32:51] No, we're just, we're just doing it.
[00:32:54] Yeah.
[00:32:54] So fascinating.
[00:32:57] And hopefully for the better.

[00:34:00] And I, I gotta tell you, I'm, you know, you and Carissa and Carl and all the people
[00:34:06] involved in Estella and all the other people involved in getting this podcast done.
